Paid Parking Returns to Downtown Galveston

City officials anticipate all parking stations will be in the ground by the end of the month. Enforcement begins this week.

Paid parking will soon return to Galveston Island’s downtown. In 2008, flood waters from Hurricane Ike destroyed 915 of the City’s parking meters. The City, with help from FEMA and guidance from the Downtown Merchants Oversight Committee, revamped the original meter footprint and applied for an improved project covering just the immediate downtown area.

City officials anticipate all parking stations will be in the ground by the end of the month.

Courtesy notices announcing paid parking’s return to downtown patrons, residents, and merchants have been in circulation. Officials are cautioning drivers: no grace period.

After a carefully documented process crews are now busy installing parking stations through out the downtown area. Numbered spaces with defined boundaries are part of the new downtown paid parking program. So are parking ambassadors, a uniformed group of trained employees who will function as way-finders and mobile visitor centers in addition to enforcing necessary parking regulations.

Adding to the innovative technology these smart parking stations will allow the parking public to pay by cash, change, or credit card and purchase additional time in their numbered slot via their cell phone. The meters also supply a Wi-Fi signal to downtown that can be accessed by visitors, businesses, and residents.

In the event of another storm, components will be removed and transported out of harm’s way.

In August 2009 the Galveston City Council entered into a public-private partnership with Ampco System Parking. Under the agreement Ampco will manage the downtown parking program as part of a revenue sharing arrangement. The City’s portion of the parking collections will first go to pay down the grant matching funds and the balance will go to the Galveston Island Convention and Visitor’s Bureau to promote and market the Island’s downtown.

Seawall Lane Closures to Affect Motorists & Pedestrians
Repairs to Flagship Pleasure Pier Require Lane Closures for Next 30 Days

Galveston, Texas June 7, 2010

Island officials are advising the public that repairs to Galveston’s Flagship Pleasure Pier will affect pedestrian and vehicular traffic on Seawall Boulevard for the next 30 days. Starting tomorrow, Tuesday, June 8th crews will begin removing the collapsed ramp in preparation for new construction as well as repairs to the property’s existing approach. Vehicular lane closures and pedestrian detours will be limited to the intersection of 25th Street & Seawall Blvd.

The public is advised that the far right east-bound traffic lane and parking lane; and the sidewalk in front of the property will be closed on and off, during the day, Monday – Friday, for the next 30 days. Pedestrians will be detoured to the north side of Seawall at the 25th Street intersection. Each evening crews will re-open the far right east-bound traffic lane and reinstate pedestrian access. The beach directly beneath the property will remain closed to the public until construction is complete.

The Flagship Hotel is a prominent reminder of the damage inflicted by 2008’s Hurricane Ike. Landry’s Restaurants Inc. unveiled plans to restore the property to its historic Pleasure Pier prominence in October 2009. Shortly thereafter corporate executives appeared in front of the Galveston City Council seeking a special use permit, the first step towards the property’s renovation. Council granted the permit later that December.

PCTH Owners:

As we approach the Easter weekend, the PCTH Board and our Managing Agent are especially pleased that the majority of the construction and repair is completed within the PCTH complex. Other than a few touch-up items, which usually occur at the end of a project, we are happy to close this "Ike chapter" and move on.

The Board realizes that some owners are planning to upgrade their television reception. For those who are considering adding a satellite dish, please know that you will need the approval of the PCTH Architectural Control Committee. The application is available at www.piratescovetownhomes.com, click on Homeowners then Architectural. For those owners who already have a satellite dish installed, you do not need to apply. The desire is to make sure that satellite dishes are not placed in unsightly areas, yet we understand that the placement is important to assure an adequate reception.

Next, there have been reports of theft along the West End, including Pirates Beach. Each owner should be especially cognizant of locking doors, not leaving items in open garages, and generally attentive to anyone who might look suspicious. Please do not hesitate to call 911 if you observe anything of a wrongful nature.

On January 29, 2010, the Association's attorney submitted a Notice & Demand Letter, on behalf of the Pirates Cove Townhome Association, to the Texas Windstorm Insurance Association. The substance of which is demand payment for economic damages, as well as expenses incurred by the Association.

If the demand is not paid, nor an equitable settlement offered within sixty (60) days from receipt of the Notice & Demand Letter delivered on January 29, 2010, the PCTH Board has authorized the Association's attorney to go forward with filing suit in Galveston County against TWIA, as well as the inspector hired by TWIA.

Hence forth, all communications and correspondence with Teas Windstorm Insurance Association is handled exclusively by our attorney from the law firm of Rick Carrasco & Associates, P.L.L.C.

Change in Comcast Contract

PCTH Owners,

Many years ago, Mitchell Development marketed the majority of the units at Pirates Cove Townhomes as fractional ownership timeshare units. In conjunction with that ownership approach, a bulk account contract was established with Time Warner Cable who has since become Comcast. Over the years as fractional ownerships were converted to full ownership units, some owners may have continued to receive cable TV services without having established a personal account with Time Warner or Comcast.

The contract has now expired and the PCTH Board of Directors has decided to provide Comcast with a Right of Entry (ROE) license agreement allowing them to step onto the common area property to maintain (actually clean up and repair/replace) the five cable pedestals located around the property that were damaged after Hurricane IKE.

Although Comcast offered some very favorable pricing under a new bulk account agreement, all units would need to be included in the pool and the Board did not want to increase costs to the owners by adding a prorated fee to the current maintenance costs and many owners have alternate providers in place or have elected no service with any provider for TV coverage.

This agreement means that services with Comcast will need to be arranged directly with each owner or with a provider of your choice (Direct TV, etc) but the ROE agreement will be in place so Comcast can step on the common area property should you choose to contract with them. I know from speaking with Comcast that many of you already have a residential agreement in place with Comcast so there will be no change in your service or relationship with them as a result of this action.

For those owners who are receiving cable TV service but do not have an account with Comcast and are NOT paying for services, please note that Comcast will be terminating the remaining units under the expired bulk account contract as of March 10, 2010 so you will need to make other arrangements with a provider of your choice for digital TV service prior to this date.

A letter will likely be sent to all owners of record directly from Comcast stating similar information and action required but thought it best that I send you an e-mail, in advance, explaining the situation as best I can.

Tonight the Galveston City Council voted to amend the city’s traffic code to prohibit electronic messaging while driving. The public may no longer use wireless communication devices to view, send, or compose an electronic message while operating a motor vehicle. The amended ordinance was brought forward by District 1 City Councilman Tarris Woods to address public safety concerns. The majority of Council members supported the amendment, with Council member Beeton casting the sole vote in opposition. Beeton expressed the desire to receive more public comment on the proposed amendment prior to voting.

Violating the ordinance is a misdemeanor offense punishable by a fine not exceeding $500. The new law goes into effect 10 days from the date of publication.

PCTH Owners:

As evidenced by the pace of roof replacements, hardi-board installation, and general construction & repair throughout the complex, The Association has been able to draw from the SBA funding. The work underway, Phase I, is following the Master Plan that was discussed at the Annual Owners' Meeting on September 26, 2009. The entire complex has new roofs, of which this particular project will be completed by Thanksgiving!

Remember that the monthly maintenance fee of $410.81 will take effect February 1, 2010. As you know, this increase is to service the SBA debt. For those of you who wish to treat this as an annual assessment, please advise Tim Towner so he can invoice you accordingly. The Board continues to work with our attorneys regarding an insurance settlement; the status of which will be forthcoming fairly soon.

While we look ahead to Thanksgiving, I think it is appropriate to pause and think of how far all of us have come since the devastation of Hurricane Ike. We are blessed that the damage to our individual units was just "things," and that we did not suffer the loss of life. I am thankful that we have, indeed, all pulled together to restore and improve the Pirates Cove Townhome complex.

Elevation of 3005 - Update

TEXDOT held a meeting at their La Marque office, November 17, 10:00 AM, to review the proposed project for the construction of raising FM 3005 and the base repairs. The following is a summary of the significant parts of the project that was discussed at the meeting.

The project will be from the end of the Seawall to the San Luis Pass Bridge. Total cost will be approximately $3.9 million and using stimulus funds.

The preparation for the project will commence immediately with sign placements, stationing vehicles, etc. Construction will start after Thanksgiving and take approximately six months, hopefully completed by March 1, 2010. The following will commence at the same time.

Texdot will start going from west (Toll Bridge) to east on FM 3005 by applying an overlay with asphalt and raising the highway anywhere from 1.5 to 3.5 inches maximum.
Texdot will start the elevation of FM 3005 at the end of the Seawall for approximately 2000 feet where the road will be raised 12 to 13 inches with an asphalt overlay.
There will be no widening of the existing roadways or changing any culverts, ditches, etc.
Culverts and outfall ditches will be delayed until a later date or unless more stimulus funds are available.
Lane closures: 8:30 AM to 4:00 PM weekdays only
Four lane roadway from the end of the Seawall to Jamaica Beach: Of the two lanes (east or west), one lane will be closed with the other lane for moving traffic.
Two lane roadway from Jamaica Beach to the Toll Bridge: One lane closed and the other lane will have flagmen to direct traffic.

PCTH Status Report

Below is a status report from Tim Towner regarding the repair and construction progress within the PCTH complex. As evidenced by this work underway, The Association has been able to draw funds from the SBA Loan for this first phase of work that is dependent on the SBA funding.

The PCTH Board, with a quorum in David Henley's absence, met with The Association's attorneys, Rick Carrasco and Louis Lippman, on Friday, October 30, 2009, in the Houston law offices of Rollin Fisher. Members of the Board, as well as managing agent, Tim Towner, thoroughly reviewed the status of the legal work done on The Association's behalf from January to October 30. Rick Carrasco was obligated by TWIA to present a settlement offer to The Board, which was not accepted by unanimous vote of The Board.

Where are we now? The Board set a dollar amount to present to TWIA as a settlement. The Board also set a timeline for acceptance, or another more tangible offer, by the end of November. Upon review of another offer, The Board will review it and either accept or move to the next step of filing suit against TWIA by the end of the year. Upon such action of accepting a settlement or moving forward with the next legal step, the owners will be advised accordingly.

Lone Star Rally Traffic Information

Later this week Lone Star Rally 2009 will roar back onto Galveston Island. Billed as "The World's Largest Halloween Party," the event boasts numerous contests, concerts, attractions, parades and vendors. The Rally will open on Thursday, October 29th and run through Sunday, November 1st. In preparation for the festivities, please review the following key information.

Emergency Operations Center (EOC)
The EOC will NOT be open for Lone Star Rally weekend. Please direct questions to the Office of Public Information by calling (409) 797-3546.

Unified Command Center
Operated by the Galveston Police Department, the Unified Command Center will be located downtown to address public safety throughout the Lone Star Rally entertainment district. Illegal and unsafe conduct will not be tolerated.

In preparation for the Rally, the following streets will be closed in the downtown area beginning Tuesday, October 27th through Sunday, November 1st.

PCTH Complex Update

Re-roofing efforts have resulted in completion of new roofs on units 23-37 and 1-4; balance to continue once SBA funding is released. Chimney enclosures and caps are being replaced, as the roofs are being replaced, to minimize the amount of foot traffic once the new roof is in place.
Lower level stucco wall replacement on waterfront units (1-27), as well as a few strategic complete wall replacements. will commence in line with SBA loan funding.
Flowers beds have been re-planted against walls that have already been replaced; future beds will be planted as additional walls are replaced with siding.
Permanent "Power of Attorney" signs have been placed at both entrances to the property.
Work orders have been released to repair/replace the vinyl fencing along the western property line, as well as leveling the waterside end of the existing dock. Fishing lights will be replaced at the end of the dock once the leveling work is complete.
Owners' planting areas throughout the complex are looking nice. Please remember to utilize the ACC form and procedures for any tree installation on the area outside the owners' planting area.

Reconstruction efforts are expected to continue over the next few months. Please be cautious around construction material and equipment, and please pick up nails and other sharp materials that you may find on the drive when walking through the complex.

Several homes (or fractional ownerships) in the complex are currently on the market and "For Sale" signs are being placed on the property. Please be advised that the governing documents address such advertising (Section 8.08 - Signs and Other Advertising) and the ACC has been tolerant of such marketing signs for a reasonable period of time. Please make sure they are placed as near to the property front entry as possible and are promptly removed once the unit is sold or the listing contract expires.

Phase III Roof Replacement ~ Units 1 - 4

As detailed on the "What to Expect" document, the Phase III Roof Replacement will commence on units 1-4 starting Monday, October 12, 2009 and will likely take until Wednesday to complete.

Please note that the area around affected buildings will be treated as a construction site with limited access for safety reasons. Please take reasonable measures within your home to protect valuables on shelves and hanging on walls as recommended in the attached document and also noted below:

“Remove all loose items from shelving and walls, pictures, mirrors, plates, figurines, etc. Hammering may create vibration that could shake these items off the shelves and walls.”

In advance of the roof replacements, the chimney enclosures located on the roof will have the stucco replaced with hardi-board and repainted to match the existing color. Making these siding upgrades prior to the roof replacement will limit the amount of foot traffic required on the roof once it is complete.

We are scheduling some project work "out of order" from what was originally planned, but we are trying to earmark available funds to buildings with less roof surface and will work back towards the larger buildings as funds are available.

Due to material delivery schedules and expected inclement weather the week of September 28th, the planned roof replacement for Phase II has been delayed until the week of October 5, 2009.

Galveston City Ordinance to Ban Golf Carts

On October 6th, the City Council will again review an ordinance relating to the ownership and use of golf carts. Please see information from the Texas Department of Transportation below.

Effective September 1, 2009, golf carts no longer can be titled or registered. If golf cart owners come in after September 1st, even if they had August renewals, they cannot register their golf carts.

NOTE: Golf carts may continue to be registered in Grayson County, but only with golf cart license plates. Golf cart license plates may not be issued in other counties, however.

Since registration renewal notices are created far in advance of the actual expiration date, customers will receive September and October registration renewal notices for golf carts. Registration should not be renewed on and after September 1, 2009 even if you have customers who present a registration renewal notice.

Renewal notices for golf carts with November 2009 or later expiration will not be mailed. We are sending letters to all golf cart owners we can identify to let them know of the change, effective September 1st. Registration for golf carts can be renewed before September 1, 2009.

We appreciate your assistance with informing golf cart customers of the following:

Registrations issued to golf carts prior to September 1, 2009, will remain valid until expiration, but will not be renewed at expiration
DPS will fully recognize and honor all existing golf cart registrations through their expiration date
Tax, title and registration fees paid prior to September 1, 2009, are non-refundable
Titles issued prior to September 1, 2009, will not be required to be returned to the department.

If municipalities allow, unregistered golf carts may continue to be operated on public roads within a municipality's boundaries, if:

The road has a posted speed limit of 35 mph or less; and
The golf cart is equipped with headlamps, tail lamps, reflectors, a parking brake and mirrors.

Additionally, state law allows unregistered golf carts to be operated on public roads or lands:

To cross intersections, including a road or street that has a posted speed limit of more than 35 mph
In a master planned community with a uniform set of restrictive covenants and a county or municipality approved plat
On a public or private beach
On a road with a posted speed limit not more than 35 mph, if driven to or from a golf course during the daytime and the golf cart is driven not more than two miles from the location where it is usually parked and the golf course

Galveston City Council Approves Tax Rate Increase

In a split vote, the Galveston City Council approved a property tax rate increase of six (6) pennies today at a special meeting. Effective October 1, 2009, Island property owners will pay $0.554/$100 value up from $0.494/$100 value. Combined with a $7 million draw from the City’s reserves, funds generated from this property tax rate increase will leverage federal recovery dollars to help rebuild Ike-battered infrastructure.

In addition to approving the tax rate, the Galveston City Council adopted a $96,532,245 budget for the City’s 2010 fiscal year.

As detailed on the "What to Expect" document from Tom Korstad with Meadows Construction, the Phase II Roof Replacement will commence on units 23-27 starting Monday, September 28, 2009 and will likely take the majority of the week to complete. The unfinished porch overhangs for units 28-30 will also be completed as part of this phase.

Water has been restored to all areas west of 81st Street. City crews successfully installed two generators at the Airport Water Pump Station this afternoon and repowered the facility.
Officials caution residents that water pressure will remain low while the system re-pressurizes. Water pressure will continue to fluctuate until the entire system refills. This process will take several hours to complete.

A boiled water notice remains in effect for all areas on Galveston Island west of 81st Street, including Treasure Island in Brazoria County. As a precaution, for the next 48 hours, or until the City of Galveston withdraws the notice, individuals are instructed to boil their water or rely on bottled water for drinking and cooking. Once the City has sampled and tested the water in accordance with TCEQ regulations, the boil water notice will be lifted. At that time, residents and business owners will need to flush their own lines by turning on indoor and outdoor faucets, both hot and cold taps, and allowing water to run for several minutes. Galveston officials are requesting all property owners west of 81st Street to turn off their irrigation systems and refrain from any outdoor watering until further notice.

"It is imperative to conserve water this weekend," stated Brandon Wade, Deputy City Manager. "Our storage tanks are empty and we must concentrate on providing water for indoor use. This means no outdoor watering, period," he added. Water service for all areas west of 81st Street, including Jamaica Beach, was disrupted earlier today due to an electrical fire that broke out at 1:56 am this morning at the City of Galveston's Airport Pump Station. The fire caused significant damage to the electrical circuit that powers the facility. The Galveston City Council convened an emergency meeting at noon today and authorized $100,000 in funding for temporary repairs. It's likely that generators will power the pump station for the next several weeks until permanent repairs are completed. City officials believe the fire started as a result of latent Hurricane Ike damage.

As of June 1, following is a status of various projects underway and /or completed at the PCTH complex. Certainly, this is a work in progress and we continue to move forward with our list of priorities. Roof replacement completed on units 28 - 37, with the exception of the porch roofs on 28 - 30, which will be completed on Wednesday, due to product delivery delays
Power has been restored to dock lights
Exterior walls restored/replaced with Hardi-board on units 37, 22, 12 (lower level) ~ units 9 & 4 will be completed the first week of June
Irrigation system repairs to be completed the first week of June
SBA loan documents have been submitted to SBA and the Board is waiting on confirmation that all is in order & the process to begin drawing on the loan
Complex wide cable went out again on Saturday morning and Comcast was on-site Sunday evening ~ request has been made for them to repair and secure their pedestals throughout the complex, which is believed to be the root of the problem
Trash pick-up resumes Monday & Thursday collection schedule first week of June
Recyclable items should be bagged separately and placed by the trash receptacle ~ if you have not replaced your trash can, please double bag to reduce the risk of critter spreading trash throughout the complex
Water will be restored to the dock after irrigation repairs are completed.
